Terms of Service

These Terms of Service (“Terms”) govern your access to and use of smartshare.social (the “Service”), an application that generates and publishes social media content based on your Shopify store data. By installing or using the Service, you agree to these Terms. The Service is operated by Legasoft Limited (“we”, “us”), a company registered in England and Wales under company number 12142132, with its registered office at 31a Long Acre, Covent Garden, London, England, WC2E 9LA.

1. The Service

SmartShare connects to your Shopify store and Instagram professional account to select products based on criteria you configure, generate posts that feature your product imagery, and publish them for your approval or automatically according to your settings.

2. Eligibility & accounts

You must have an active Shopify store and the authority to connect the Instagram accounts you link. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.

3. Your content & license

You retain all rights to your products, imagery, and brand. You grant us a limited license to access and process this content solely to provide the Service, including sending your product photos and details to the AI providers named in our Privacy Policy, staging your product imagery, and publishing posts on your behalf. You confirm that you have the rights to the product photos and details in your store that the Service works from. We claim no ownership of the posts generated for your store.

4. AI-generated content

The Service generates images and videos with AI models; a carousel also carries your own product photos. Captions are generated too, except where caption generation is switched off or a caption could not be generated (the caption then comes from your own caption template or from the product's title), and you can edit or replace any caption before it is published. We check each generated image against your product photo before it can publish, and one that does not pass, or that we cannot check, waits for your approval instead. No automatic check is perfect: generated content can still show a product inaccurately or say something that is not true of it.

• You decide what is published. The approval settings let you see every post before it goes out; when you let posts publish automatically, they go out without your review.
• You are responsible for what is published to your accounts through the Service: that it describes your products, prices and offers truthfully, and that it meets the laws and platform rules that apply to you, including any duty to tell your audience that content was made with AI.
• Tell us about a generated post that misrepresents a product, and remove it from your account; we use such reports to improve the checks.

5. Acceptable use

• Do not use the Service to publish unlawful, infringing, or deceptive content.
• Do not attempt to disrupt, reverse-engineer, or abuse the Service.
• Comply with the terms of Shopify and Instagram (Meta) at all times.

6. Plans, credits & billing

Paid plans and credit top-ups are billed through Shopify and appear on your Shopify invoice. A free plan is available with no card required. Creating a post uses credits from your plan or a top-up; plan limits and credit prices are described on our pricing page and in the app. Credits charged for a post that could not be generated are returned automatically.

You can switch between paid plans at any time from the app. You can cancel your paid plan at any time directly inside the app (downgrade to the free plan), by cancelling the subscription from your Shopify admin, or by uninstalling the app; paid features end when the subscription is cancelled, and Shopify's billing terms govern any proration or refunds of the current billing period.

7. Third-party platforms

The Service depends on Shopify and Instagram (Meta) APIs and on the AI providers that generate content. We are not responsible for changes, outages, or policy decisions made by those platforms that affect the Service.

8. Ending or suspending use

You can stop using the Service at any time by uninstalling the app; what happens to your data then is described on our Data Deletion page. We may suspend or end access for a store that breaks these Terms, abuses the Service, or puts it or other stores at risk.

9. Disclaimers

The Service is provided “as is” without warranties of any kind. We do not guarantee that generated content is accurate or free of errors, or any specific reach, engagement, or sales outcome from published posts.

10. Limitation of liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited by law.

11. Governing law

These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute about them, unless the law where you are gives you a right that cannot be set aside.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the app or by email, and continued use after changes take effect constitutes acceptance.
