SmartShare is a social media automation service that helps users create and schedule content for their social media accounts. The service uses AI to generate media content (images or videos) based on user-provided prompts and automatically posts this content to connected social media accounts at specified times.

3. User Accounts

To use our service, you must create an account and provide certain information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to:

Provide accurate and complete information when creating your account
Update your information as needed to keep it accurate and current
Notify us immediately of any unauthorized access to or use of your account
Ensure that you exit from your account at the end of each session

4. Social Media Account Authorization

Our service requires access to your social media accounts to post content on your behalf. By connecting your social media accounts to our service, you:

Authorize us to access your accounts and publish content
Confirm that you have the right to grant such authorization
Acknowledge that your use of third-party social media platforms is subject to their respective terms of service

You can revoke our access at any time through our service or directly through your social media platform's settings.

4.1 Facebook and Instagram Permissions

SmartShare exclusively uses Facebook and Instagram login for authentication and service functionality. By using our service, you authorize us to request the following specific permissions:

email: To access your email address for account identification and communications
public_profile: To access basic information from your profile including name and profile picture
instagram_basic: To access basic information about your Instagram account
instagram_content_publish: To publish content to your Instagram account on your behalf
pages_show_list: To view the Facebook Pages you manage
pages_read_engagement: To access metrics about your Facebook Pages
business_management: To manage your business assets if you've connected a business account

You understand and agree that these permissions are necessary for SmartShare to function properly. Without these permissions, we cannot provide our core services of automated content creation and posting to your connected accounts.

You further acknowledge that you are responsible for complying with Facebook's and Instagram's terms of service while using our service, and that changes to their APIs or policies may affect how SmartShare functions with your accounts.

5. Content Generation and Responsibility

Our service uses AI to generate content based on your prompts and preferences. While we strive to create appropriate and high-quality content, you are ultimately responsible for all content posted to your social media accounts through our service. You agree to:

Review generated content before scheduling or posting when possible
Not use our service to generate or post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Not use our service to infringe on intellectual property rights or violate any third-party rights
Comply with all applicable laws and regulations regarding social media content

6. Subscription and Payment

Some features of our service require a paid subscription. By subscribing to our service, you agree to pay the applicable fees as they become due. We may modify subscription fees at any time, but will provide advance notice of any fee changes.

Subscriptions automatically renew unless canceled before the renewal date. You can cancel your subscription at any time through your account settings.

All payments are processed by Stripe and go to LEGASOFT LIMITED, the company that operates the SmartShare service.

7. Intellectual Property

All content generated through our service is owned by you. However, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display such content solely for the purpose of providing and improving our service.

Our service, including its features, functionality, and underlying technology, is owned by LEGASOFT LIMITED and is protected by copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

To the maximum extent permitted by law, LEGASOFT LIMITED and its affiliates, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the service.

9. Service Availability and Modifications

We strive to ensure that our service is available at all times, but we do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue the service, temporarily or permanently, with or without notice.

We may update these Terms of Use from time to time. We will notify you of any changes by posting the new terms on our website and updating the "Last Updated" date. Your continued use of the service after such changes constitutes your acceptance of the new terms.

10. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms of Use.

Upon termination, your right to use the service will immediately cease. All provisions of these Terms of Use which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
